Gross misconduct

  • Complaints

A breach of the Standards of Professional Behaviour so serious that it would justify dismissal. Under the Police (Conduct) Regulations 2020, gross misconduct is determined at a misconduct hearing chaired by an independent legally qualified person. If the finding is proved, the panel may impose dismissal without notice, a final written warning, or (in limited circumstances) a reduction in rank.

In practice

A misconduct hearing is a formal, adversarial process at which the officer has the right to legal representation. The IOPC may refer matters to the hearing panel and has powers of appeal over decisions it considers unduly lenient. Officers dismissed for gross misconduct are placed on the College of Policing's barred list and cannot be re-employed in policing.
