Safeguards for Search Warrants

PACE 1984, s.15

  • Warrant: Yes
  • Force: Yes
  • Notice: No

Sets out the procedural safeguards that must be followed when applying for and executing search warrants under any enactment. Section 15 requires that all applications be supported by sworn information in writing, specify the premises and the articles or persons sought, and comply with formal requirements. Non-compliance may render a warrant unlawful and evidence obtained inadmissible.

Conditions

  • Application must be made by a constable and supported by an information in writing
  • The constable must answer on oath any question the justice of the peace asks
  • The application must state the ground on which the warrant is sought and the enactment under which it is issued
  • The warrant must specify the premises to be searched and, so far as practicable, the articles or persons to be sought

Limitations

  • Non-compliance with s.15 requirements may render the warrant void and any search unlawful
  • A warrant does not authorise entry on more than one occasion unless expressly stated
  • The warrant must be produced on request by the occupier of the premises
