Entry and Search Following Certificate Revocation

Firearms Act 1968, s.46

  • Warrant: Yes
  • Force: Yes
  • Notice: No

Where a firearm or shotgun certificate has been revoked, a constable may be authorised by a warrant issued by a justice of the peace to enter and search premises for the purpose of seizing any firearms, ammunition, or shotgun cartridges which the person whose certificate has been revoked is no longer entitled to possess. The power ensures that firearms are recovered promptly following revocation.

Conditions

  • A firearm or shotgun certificate must have been revoked by the chief officer of police
  • A warrant must be obtained from a justice of the peace
  • The warrant must specify the premises to be searched and the items to be seized

Limitations

  • The warrant is limited to firearms, ammunition, and shotgun cartridges: it does not authorise a general search
  • The former certificate holder must be given the opportunity to surrender firearms voluntarily before a warrant is sought where practicable
  • Seized firearms must be dealt with in accordance with police force procedures for firearm disposal
